CrowdSpark Ltd (“CrowdSpark”) is committed to protecting the privacy and confidentiality of the information you provide to us. This Privacy Policy outlines our online collection, use and disclosure of data. This Privacy Policy applies to all CrowdSpark services, including but not limited to the Websites, Apps or any other content, product, service or feature available through the Websites or the Apps owned and operated by or otherwise under the control of CrowdSpark (“Services”).

This Privacy Policy forms part of the Terms and Conditions of Use (collectively the “Terms”) and should be read in conjunction with those Terms. Any terms not defined in this Privacy Policy are defined in the Terms and Conditions of Use.  Use of Third Party products, services, or processes, including without limitation our clients using our technology, are subject to their own privacy policies and should also be reviewed before use.

 

Notification of changes to this Privacy Policy

 

If and when our data collection practices change, due to changes in law, technology or potential modifications to our Services, we will notify you of those changes via this page. The updated version will be linked on the Websites, and emailed to all Registered Users at their nominated email address, and we will revise the ‘last updated’ date at the top of the Privacy Policy. We encourage you to check this Privacy Policy frequently.

 

Collection and Use of Personal Information

 

Personal information refers to information about an identifiable individual including, but not limited to, your name, job description, birthday, email address, certain location data or postal address. You may be asked to provide your personal information in order to receive information, advice, or Services from us. This information is either manually or electronically stored in our databases. By submitting personal information manually or in electronic form to us and/or by using our Services you give your consent to such information being used by CrowdSpark and its affiliates in the manner set out in this Privacy Policy.

Registration: In order to register with us (“Registered User”), you will be required to share some personal information such as your full name, email address, username, city and phone number (at your option). You do not have to be a Registered User to visit the Websites or use the Services however you will have to register in order to upload User Content (as defined in our Terms and Conditions) to the Services, and make full use of the Services. We use this registration information to identify who you are, to send you Newscalls, and to otherwise administer your Account.

Once you register, you will have an Account with CrowdSpark and a password to access that Account. You must not use another person’s Account without permission and you may not use anyone else’s password. We recommend that you keep your password secure and confidential and you always log out from your account at the end of a session to prevent other people from accessing your Account without your permission. You are obliged to provide true and accurate information in your public profile and any breach of this may result in provision of the Service to you being suspended. You are solely responsible for any activity occurring on your Registered User Account.

Your public profile: Once you become a Registered User, you may provide additional information to your CrowdSpark profile that describes your experience, interests, previous work or any other information. Any information you provide to CrowdSpark beyond the minimum that is required for registration is voluntary. Any information you provide at registration or in your personal profile may be used in the manner described in this Privacy Policy.

You can review the personal information you provide to us and make changes to the information you publish, or to the settings for your Account, at any time by logging into your Account on the Website. Please be aware that even after your request for change has been processed we may, for a short time, retain residual information about you in the backup and/or archival copies of the database.

 

Content Submissions

When you upload User Content to the Services we may also collect the following information in order to correctly verify and validate images:

  • location, date and time the image or video was taken and sent to us;
  • the make and model of the device;
  • whether the User Content has been edited by you;
  • how many times you have uploaded User Content to our Services; and
  • whether previous User Content has been validated, deleted or sold by us.

If we make a sale of your User Content, we may also request additional information from you, such as your banking or PayPal account details, in order to make a payment to you.

Email Communications: We may collect certain personal information (such as first and last name and email address) to send you email communications about news, press publications and our Services. You can unsubscribe from our email communications by following the instructions in our communications or by contacting us as set out in the “Unsubscribe” section below.

Interactive Services: Our Services may contain interactive areas, including but not limited to discussion forums, blogs, chat rooms, message boards, or other areas in which you or third parties post or store content, messages, comments, materials or other items (“Interactive Services”). In order to participate in these Interactive Services we may request certain personal information such as your name and email address. We may use your comments to monitor and/or improve our Services. Please remember that any information that you provide in these Interactive Services are accessible to all users of the Services, and you should exercise caution when deciding to disclose any personal information about yourself or anyone else.

Contact Us: If you choose to contact us with a comment, suggestion or feedback, we may collect your name, e-mail address, mobile number and the comments, suggestions or feedback you provide. We use this information to respond to you and we may retain it to assist you in the future. We also may use your comments, suggestions or feedback to monitor and/or improve our Services.

Service Providers: CrowdSpark may share your personal information with service providers and affiliates in the United States, Canada, Europe, Australia and other jurisdictions who provide services on our behalf that are consistent with this Privacy Policy including but not limited to:

  • Managing your Account and Content you upload or license from the Services;
  • Contacting you in regards to a pending payment;
  • Processing your request for information or advice;
  • Helping diagnose any problems with our server and administer our Services.

Our service providers are subject to their own privacy policies that are not guaranteed by CrowdSpark. For details about the way in which our service providers treat your personal information, contact us as set out below.

Legal: We and our service providers may disclose or share your personal information in order to comply with any legal obligation (including a search warrant, or other legally valid inquiry or order), or in order to enforce or apply our Terms and Conditions of Use, or to protect the rights, property, or safety of CrowdSpark, our customers, or others, or as otherwise required or permitted under Canadian, United States, European, Australian or other applicable law. We may also disclose personal information where necessary for the establishment, exercise or defense of legal claims.

Sale of Business: We may transfer any information we have about you as an asset in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of CrowdSpark or as part of a corporate reorganization or other change in corporate control.

 

Storing Your Personal Information

 

In operating our Services it may become necessary to transfer data that we collect from you to locations outside of your jurisdiction of residence for processing and storing, including the United States, Canada, Europe and Australia. By providing your personal information to us, you agree to this transfer, storing or processing. We do our utmost to ensure that all reasonable steps are taken to make sure that your data is treated and stored securely.

We have implemented reasonable administrative, technical and physical safeguards designed to protect personal information in our custody and control from unauthorized access, use, modification and disclosure of personal information in our custody and control. Governing Law

 

This Privacy Policy forms part of our Terms and such, as any dispute, controversy, proceedings or claim of any nature arising out of or in any way relating to this Privacy Policy, shall be governed by and construed in accordance with the laws of Western Australia. You and CrowdSpark submit any disputes arising out of or in connection with these Terms to the exclusive jurisdiction of the Courts of Australia.

 

Access to Information

 

You may have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. If you are a Registered User, you can access and update certain of your personal information through your Account. Please note that, where permitted by law, we reserve the right to charge a small fee to cover costs incurred by us in providing you with the information.
