CrowdSpark (as defined in the Terms and Conditions of Use) is committed to protecting the privacy and confidentiality of the information you provide to us. This Privacy Policy outlines our online collection, use and disclosure of data. This Privacy Policy applies to all CrowdSpark Services, including but not limited to the Websites, Apps or any other content, product, service or feature available through the Websites or the Apps owned and operated by or otherwise under the control of CrowdSpark.

This Privacy Policy forms part of the Terms and Conditions of Use (collectively the “Terms”) and should be read in conjunction with those Terms. Any terms not defined in this Privacy Policy are defined in the Terms and Conditions of Use.  Use of third party products, services, or processes, including without limitation our clients using our technology, are subject to their own privacy policies and should also be reviewed before use.

Notification of changes to this Privacy Policy

If and when our data collection practices change, due to changes in law, technology or potential modifications to our Services, we will notify you of those changes via this page. The updated version will be linked on the Websites, and emailed to all Registered Users at their nominated email address, and we will revise the ‘last updated’ date at the top of the Privacy Policy. We encourage you to check this Privacy Policy frequently.

PERSONAL INFORMATION

Personal information refers to information about an identifiable individual including, but not limited to, your name, job description, birthday, email address, location data or postal address. You may be asked to provide certain personal information in order to receive information, advice, or Services from us. This information is either manually or electronically stored in our databases. By submitting personal information manually or in electronic form to us and/or by using our Services you give your consent to such information being used by CrowdSpark in the manner set out in this Privacy Policy.

COLLECTION AND USE OF PERSONAL INFORMATION

Registration: In order to register with us (“Registered User”), you will be required to share your full name and email address with us.  Any further information you provide is completely voluntary. You do not have to be a Registered User to visit the Websites or Apps, or use the Services however you will have to register in order to upload User Content (as defined in our Terms and Conditions) to the Services, and make full use of the Services.

Once you become a Registered User, you may provide additional information to your CrowdSpark profile that describes your experience, interests, previous work or any other information. We also collect location data through your device which can be turned off at any time through your device settings. Any information you provide to CrowdSpark beyond the minimum that is required for registration is voluntary. Any information you provide at registration or in your personal profile may be used in the manner described in this Privacy Policy.

Account: Once you register, you will have an Account with CrowdSpark and a password to access that Account. You must not use another person’s Account without permission and you may not use anyone else’s password. We recommend that you keep your password secure and confidential and you always log out from your Account at the end of a session to prevent other people from accessing your Account without your permission. You are obliged to provide true and accurate information in your public profile and any breach of this may result in provision of the Service to you being suspended. You are solely responsible for any activity occurring on your Registered User Account.

You can review the personal information you provide to us and make changes to the information you publish, or to the settings for your Account, at any time by logging into your Account on the Website or App. Please be aware that even after your request for change has been processed we may, for a short time, retain residual information about you in the backup and/or archival copies of the database.

Content Submissions: When you upload User Content to the Services we may also collect the following information in order to correctly verify and validate User Content:

  • location, date and time the image or video was taken and sent to us;
  • the make and model of the device;
  • whether the User Content has been edited by you;
  • how many times you have uploaded User Content to our Services; and
  • whether previous User Content has been validated, deleted or sold by us.

If we make a sale of your User Content, we may also request additional information from you, such as your banking or PayPal account details, in order to make a payment to you. You are encouraged to set up an account with PayPal to facilitate the payment.  If you do not have a PayPal account, your banking information will be requested and will be used be for a one-time payment transfer, and then immediately deleted.  It is CrowdSpark’s policy to not retain or store any financial information.

The purchasers of your User Content will not receive any of your information unless you want to receive credit for your User Content. You have the option to Upload anonymously and your personal information will not be transferred to any third party.  Otherwise, your full name as per your Account will be transferred with your User Content and you will receive credit. Our partners agree to keep any personal information received from CrowdSpark safe and secure.

Your content and information may be used for marketing and Promotional Purposes, including on the Websites, Apps, or corporate materials of CrowdSpark. Your personal information will never be sold to third parties for marketing.  You can update your preferences for these uses at any time through your Account.

Communications: We may use your first and last name, email address, and phone number (if provided) to communicate with you about your Account, User Content, or payments.  We may also send email communications or newsletters regarding service updates, news, press publications, Newscalls and our Services. You can unsubscribe from any marketing related communication by following the instructions in such communication, by updating your communication preferences on your Account, or by contacting us as set out in the “Your Rights” section below. Newscalls use geolocated and group based push notifications on your mobile device to alert you to local news breaking in your area. You can stop Newscalls by turning off geolocation and push notifications on your device settings.

Product Development: the information you provide to CrowdSpark is used to help us understand how Users interact with our Services.  We use your information to perform analytics, assess web traffic and user interactions, and strengthen our machine learning and artificial intelligence capabilities.  This information allows us to monitor and improve our Services to provide you with the best possible service.

Interactive Services: Our Services may contain interactive areas, including but not limited to discussion forums, blogs, chat rooms, message boards, or other areas in which you or third parties post or store content, messages, comments, materials or other items (“Interactive Services”). In order to participate in these Interactive Services we may request certain personal information such as your name and email address. We may use your comments to monitor and/or improve our Services. Please remember that any information that you provide in these Interactive Services are accessible to all users of the Services, and you should exercise caution when deciding to disclose any personal information about yourself or anyone else.

Contact Us: If you choose to contact us with a comment, suggestion or feedback, we may collect your name, e-mail address, phone number and the comments, suggestions or feedback you provide. We use this information to respond to you and we may retain it to assist you in the future. We also may use your comments, suggestions or feedback to monitor, improve, and/or promote our Services.

Use of Cookies: Cookies provide information regarding the computer used by a visitor. We may use cookies where appropriate to gather information about your computer in order to assist us in improving our Services.

We may also gather information about your use of our Websites by using cookies. Where used, these cookies are downloaded to your computer and stored on the computer’s hard drive. We use the information obtained from cookies to let us know who you are and personalize our Services in accordance with your preferences.

You can adjust the settings on your computer to decline any cookies if you wish. This can easily be done by activating the ‘reject cookies’ setting on your computer. Please note that if you decide not to accept cookies from our Websites, you may not be able to take advantage of all of the features of our Services.

DISCLOSURES AND TRANSFERS OF PERSONAL INFORMATION

Service Providers: CrowdSpark uses trusted third party service providers to perform functions and provide services to us. CrowdSpark may share your personal information with these service providers but only to the extent necessary to provide the Services and only under agreements requiring such parties to maintain the privacy and security of your data consistent with this Privacy Policy. Our third parties provide services including but not limited to:

  • Managing your Account and Content you upload or license from the Services;
  • Contacting you in regards to a pending payment;
  • Processing your request for information or advice;
  • Helping diagnose any problems with our server and administer our Services.

Our service providers are subject to their own privacy policies that are not guaranteed by CrowdSpark. For details about the way in which our service providers treat your personal information, contact us as set out below.

Storing and Managing Your Personal Information: In operating our Services it may become necessary to transfer data that we collect from you to locations outside of your jurisdiction of residence for processing, storing, and performing analytics. CrowdSpark transfers data using appropriate safeguards and in compliance with data protection laws to service providers obliged to maintain the privacy and security of your data consistent with this Privacy Policy.  By providing your personal information to us, you agree to this transfer, storing and processing. We do our utmost to ensure that all reasonable steps are taken to make sure that your data is treated and stored securely.

Safeguarding Your Personal Information: We have implemented reasonable administrative, technical and physical safeguards designed to protect personal information in our custody and control.  CrowdSpark has policies and controls to monitor unauthorized access, use, modification, breaches, and disclosure of personal information in our custody and control. However, sending of information via the internet is not totally secure and on occasion such information can be intercepted. We cannot guarantee the security of data that you choose to send us electronically; sending such information is entirely at your own risk.  In the event CrowdSpark becomes aware of a security breach involving your data held by CrowdSpark we will notify you in compliance with applicable data protection laws.

Legal: We and our service providers may disclose or share your personal information in order to comply with any legal obligation (including a search warrant, or other legally valid inquiry or order), or in order to enforce or apply our Terms and Conditions of Use, or to protect the rights, property, or safety of CrowdSpark, our customers, or others, or as otherwise required or permitted under applicable law. We may also disclose personal information where necessary for the establishment, exercise or defense of legal claims.

Sale of Business: We may transfer any information we have about you as an asset in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of CrowdSpark or as part of a corporate reorganization or other change in corporate control.

Third Party Links: On occasion we include links to third parties on our Services that are not operated by us. Where we provide a link it does not mean that we endorse or approve that site’s policy towards visitor privacy. We encourage you to review the privacy policy of any third parties before sending any personal information.

 

YOUR RIGHTS

You have rights regarding how your personal data is used, including but not limited to the right to:

  • Access your data;
  • Have information about how we process your data;
  • Restrict how we process your data;
  • Update your data;
  • Have your data permanently erased;
  • Have your data transferred.

Access to Information: You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. If you are a Registered User, you can access and update certain of your personal information through your Account. Otherwise, you can contact us by sending an email to newsroom@crowdspark.com or by writing to us at the postal address above.

Updating Data and Consent: Please ensure all of your personal information is kept up-to-date to facilitate the provision of Services. You can update any information or consent preferences you have given to us by logging into your Account, sending an email to newsroom@crowdspark.com, or by writing to us at the postal address above. Where required to do so by law, we will correct, amend or delete any personal information that you notify us is inaccurate and will notify any third party recipients of necessary changes.  Please be aware that even after your request for change has been processed we may, for a short time, retain residual information about you in the backup and/or archival copies of the database.

Erase Account or Unsubscribe: If you no longer wish to receive information from us and would like to be removed from our mailing list, or if you are a Registered User and you would like to erase your Account, you can make a request by emailing newsroom@crowdspark.com or by writing to us at the postal address above. Erasing your Account will permanently delete all personal information and User Content Uploaded to the Services.  Upon erasure, this information will no longer be accessible or available for distribution or licensing. We will reply to your request as soon as possible, within a reasonable time and subject to any pending payments, and you will be notified when the request is completed.

Children: We will not solicit or knowingly collect personal information from anyone under the age of 16. If you are under 16 years old, you may not use or enter information on the Services, including without limitation, any Interactive Areas of the Websites.

Governing Law: This Privacy Policy forms part of our Terms and as such, any dispute, controversy, proceedings or claim of any nature arising out of or in any way relating to this Privacy Policy, shall be governed by and construed in accordance with the laws of Western Australia, Australia or as otherwise required by applicable law. You and CrowdSpark submit any disputes arising out of or in connection with these Terms to the exclusive jurisdiction of the Courts of Australia.
